Gujarat High Court Chief Justice’s elevation to SC cleared



Gujarat High Court’s Chief Justice Shri S.J. Mukhopadhyaya’s name has been cleared for elevation to the Supreme Court of India in recent meeting of the Supreme Court collegium headed by Chief Justice Shri. S.H.Kapadia in Delhi as per a report published in Delhi based daily. Also cleared are the names of Chief Justice of Karnataka High Court J.S.Khehar and Justice Ranjana Desai of the Bombay High Court as per a report. As per convention, every State is represented by at least one judge at any point of time. Shri Mukhopadhyaya will represent Jharkhand. Justice Khehar who has chance of his becoming the Chief Justice of India(in that case the first Sikh CJ of India) will represent Punjab. Justice Desai (Kasab case fame) will represent Maharashtra. Gujarat is represented by two Judges Shri JM Panchal and Shri Anil Dave. Justice Panchal will be retiring on October 5 this year.

Quoting a source, the report claims that the Union Law Ministry has reportedly received proposals from the Supreme Court for elevation of three Judges(Mukhopadhyaya, Desai and Khehar) and the process of appointment is expected to be completed in two to three weeks.

In the apex court’s sanctioned strength of 31 judges. The present strength is 28. Six judges are due to retire in the next two months upon reaching the age of 65. The are: Justice V.S. Sirpurkar(August 21); Justice H.S. Bedi( September 4); Justice Mukundakam Sharma(September 17); Markandey Katju(September 19) and Justice R.V. Raveendran (October 14).
