May 13, 2026
Bhuj: Three days after the tragic accident near Khawda in Kutch that claimed three lives and left several others injured, police have registered a case against the contractor responsible for the culvert construction work and others who may be found responsible during the investigation.
According to the complaint lodged at Khawda Police Station by Amad Ibrahim Sama of Madhapar, the accident occurred on the Dadhar-Sadhara road where a large pit had been dug for culvert construction work. The complainant stated that he was returning from GK General Hospital in Bhuj after discharging family members following a delivery case.
Amad Sama was travelling in his Swift car bearing registration number GJ-12-BR-6218 along with his mother-in-law Amiyatbai Latif Sama, father-in-law Latif Umar Sama, daughter Afsin, and relatives Noorbai Juma Sama and Rehanabai Hakim Sama. While travelling towards their village at night, the vehicle plunged into the pit allegedly due to the absence of warning signs, barricades, diversion boards, or any safety arrangements at the construction site.
In the accident, complainant Amad Sama, his father-in-law Latif Sama, and daughter Afsin sustained injuries. Noorbai Juma Sama and Rehanabai Hakim Sama later died during treatment.
The accident also involved two motorcycles approaching from the opposite direction. Umr Hasan Bandha of Sadhara and pillion rider Ibrahim Hussain Sama of Dedhia suffered serious head injuries after their motorcycle crashed near the site. In another motorcycle accident linked to the same pit, rider Juma Alu Kalar died due to severe head injuries, while pillion rider Mustafa Alu Kalar sustained minor injuries.

Based on the complaint, police have registered an offence against the contractor handling the culvert work and any other persons found responsible during the probe. The case has been filed under Sections 105, 110, 125(A), and 125(B) of the Bharatiya Nyaya Sanhita (BNS). Further investigation is underway.
Here’s a simple explanation of the sections of the Bharatiya Nyaya Sanhita (BNS) mentioned in the Khawda road accident case:
- Section 105 – Culpable Homicide Not Amounting to Murder
This section applies when a person’s act causes someone’s death, even if there was no direct intention to commit murder, but there was knowledge that the act was dangerous and could likely cause death.
In this case, police may be examining whether negligence in leaving the pit open without safety measures led to the deaths. - Section 110 – Attempt to Commit Culpable Homicide
This section deals with acts that are dangerous enough to potentially cause death, even if the victim survives.
Since several people were seriously injured in the accident, this section may have been added for the injured victims. - Section 125(A) – Act Endangering Life or Personal Safety of Others
This provision applies when a negligent or reckless act puts human life or safety at risk.
Allegedly failing to place barricades, warning boards, or diversions around a deep roadside pit can fall under this category. - Section 125(B) – Causing Hurt or Grievous Hurt by Negligent Act
This section applies when negligence results in injuries to people.
Because multiple victims suffered injuries in the crash, police invoked this section as well.
Together, these sections indicate that investigators are treating the incident not merely as an accident, but as a case of alleged serious negligence that resulted in deaths and injuries. DeshGujarat
