Leader of Opposition in the Rajya Sabha Shri Arun Jaitley expressing his views on the issue of the Amicus Curiae report.
Speaking on the issue of the Amicus Curiae, Shri Arun Jaitley said that it is first and foremost essential that we are aware of the legal position of the matter.
He pointed out that trials of this kind are carried with reference to the Code of Criminal Procedure and the Indian Evidence Act. There is n place for an advocate or Amicus Curiae in a criminal trial.
He also reminded that this is a Supreme Court appointed SIT and it is only the SIT that can file the charge sheet. He reaffirmed that the Amicus is an advocate not the investigator.
